Conditions of participation for competitions

The competitions are run by Sportsbabe GmbH, Zwischen den Wegen 60, 75196 Remchingen. These competitions are not connected to Facebook, Instagram or other social media channels and are in no way sponsored, supported or organised by Facebook, Instagram or similar. The contact person and person responsible is Sportsbabe GmbH alone.

Sportsbabe GmbH reserves the right to change or completely discontinue the competition at any time, without this giving rise to any claims on the part of the participants.

Violation of these conditions of participation will result in exclusion from the respective competition.

 

1. Participation and eligible participants

Participation in the promotion takes place via the post on Instagram in the form of a comment under the competition post or the purchase of products on our homepage (www.sportsbabe-shop.com). Participation is not associated with any costs. Participation is open to natural persons who are permanently resident in Germany or Austria, have reached the age of 18 and are registered with Facebook or Instagram.

The comment submitted by the participant must match the specifications of the competition given by Sportsbabe GmbH.

Manipulations, disruptions of the competition, violations of these conditions of participation, unfair or illegal actions, the use of unauthorised aids of any kind and participation with false profiles or accounts are prohibited and will lead to exclusion from the competition. There is no right to participate.

Contributions that violate legal provisions, the rights of third parties or morality and/or that contain defamatory, discriminatory, offensive, racist or otherwise objectionable content are expressly not permitted. Sportsbabe GmbH expressly reserves the right to remove such entries without prior notice and without giving reasons and to exclude the participant from the competition.

Sportsbabe GmbH reserves the right to exclude persons from participation at its own discretion if there are justified reasons.

 

2.Subject to change

Sportsbabe GmbH also reserves the right to terminate, cancel, suspend or modify the competition in the event of unforeseen circumstances beyond the control of Sportsbabe GmbH which prevent the proper conduct of the competition.

 

2. Profit determination

The winner will be selected at random from all eligible participants within one week of the end of the competition. Only those users who have completed the task correctly will be entered into the draw. Only one submitted registration or one purchase in the competition is valid per participant. It is strictly prohibited to use multiple Instagram accounts or profiles to increase your chances of winning. The prize is not transferable, nor can the prize be exchanged or paid out in cash. The prize will be awarded exclusively to the winner. Compliance with the conditions of participation is a prerequisite for participation in the prize draw.

The winner will be notified by email and, if not available, by Instagram direct message and requested to respond to this message within 3 days of the announcement or notification of the prize, stating their full name and address. Should the winner fail to do so within this period, the claim to the prize will expire.

The legal process is excluded.

A cash payment of the value of the prize is not possible. The prize is not transferable.

The winners may be announced on the Sportsbabe GmbH account. First name written out in full, last name abbreviated. The announcement of the winners is made without guarantee.

 

3. Winning Vouchers & Codes

3.1 Vouchers which are issued free of charge by the Seller as part of promotions with a specific period of validity and which cannot be purchased by the Customer (hereinafter "Promotion Vouchers") can only be redeemed in the Seller's online shop and only within 15 days (unless otherwise communicated).
3.2 Individual products may be excluded from the voucher promotion if a corresponding restriction results from the content of the promotion voucher.
3.3 Promotion vouchers can only be redeemed before the order process is completed. Subsequent offsetting is not possible.
3.4 Only one promotional voucher can be redeemed per order.
3.5 The value of the goods must be at least equal to the amount of the promotional voucher. Any remaining credit will not be refunded by the Seller.
3.6 If the value of the promotional voucher is not sufficient to cover the order, one of the other payment methods offered by the Seller may be chosen to settle the difference.
3.7 The credit balance of a promotional voucher is neither paid out in cash nor does it earn interest.
3.8 The promotional voucher will not be refunded if the customer returns the goods paid for in full or in part with the promotional voucher within the scope of his statutory right of withdrawal.

3.9 The Gift Voucher is not transferable. The Seller may make payment with discharging effect to the respective holder redeeming the gift voucher in the Seller's online shop. This shall not apply if the Seller has knowledge or grossly negligent ignorance of the ineligibility, legal incapacity or lack of representative authority of the respective holder.

4. Data protection information competition

Within the scope of participation in the competition, we process the following data:
Name, First name. Address, E-mail address, Social media account data

The purposes of the processing are: Carrying out the competition, determining the winner, informing the winner of their name and social media profile. Communication with the winners and delivery of the prize.

Legal basis: Art. 6 para. 1 lit. b DSGVO (implementation of pre-contractual measures or fulfilment of a contract)

Rights

The participant has a right of access to the personal data concerned as well as the right to rectification or erasure or to restriction of processing or a right to object to processing as well as the right to data portability.

In the event of a breach, the participant has the right to lodge a complaint with a supervisory authority.
